This program will present key aspects of ACEC New York's LL97 Reference Guide White Paper. Michael De Chiara will discuss design team liability.

In 2019, New York City enacted Local Law 97 (LL97) which places carbon caps on most commercial and residential buildings larger than 25,000 square feet Citywide. The caps take effect in 2024 and become more stringent over time.

LL97 is precedent-setting in that the law sets forth outcome-based building performance requirements.  To achieve the building outcomes required by the law, there are four key stakeholders who need to engage in active, careful coordination: Design Team, Owners, Contractors, and Operations.

LL97 established an Advisory Board to help the City refine the prescribed emissions caps. The law requires the Advisory Board to recommend “A reference guide to delineate the responsibilities of the building designer and owners to comply with emissions limits.”

To support implementation of this requirement, ACEC New York’s Metro Energy Code Committee has created a White Paper: “Recommendations for the Reference Guide Required by Local Law 97 of 2019”. The White Paper provides detailed recommendations to: 

  • Make stakeholders’ responsibilities clear and necessary coordination clear.
  • Establish a standard for building energy system design as it relates to emissions that can be referenced in conjunction with building code and standards.
  • Identify accountability in the case of noncompliance.

During this program, Scott Frank PE, Josephine Zurica PE, chair and vice-chair, and members of the Metro Energy Code Committee, will present key aspects of ACEC New York’s LL 97 Reference Guide White Paper. They will be joined by Michael De Chiara, Senior Partner of Zetlin & De Chiara, who will engage with members on issues related to design team liability.
